MSNBC is expected to face criminal charges in the coming days in federal court in Virginia on Wednesday, former FBI director James Comey.
The news comes days after a US lawyer for the Eastern District of Virginia resigned after being pressured by President Donald Trump after opposed the filing of charges against Comey.
Comey has been the target of Trump’s rage for years.
The president was called Comey “Hell as a Criminal” in a social media post on Saturday after he was furious over the lack of criminal charges against the former FBI leader.
MSNBC reporter Ken Dianian said in a post on X that Comey is expected to be charged in the Eastern District of Virginia, according to three people familiar with the matter.
“The full scope of the charges being prepared against Comey is unknown, but sources believe that if he accused him of lying to Congress on September 30, 2020, whether he allowed the leak of information, then at least one element of the charge will condemn him,” the Diranian tweeted.
That day, Sen. Ted Cruz of R-Texas asked Comey that day for an October 2016 article about the Department of Justice investigation into the email use of then-democratic presidential candidate Hillary Clinton, as FBI director, when he said he was not lying.
Dilanian, who reported Wednesday with his MSNBC colleague Carol Leonnig, noted that the five-year restriction law on the charges would expire next Tuesday.
In a December 2020 letter to the Department of Justice, Cruz wrote that former FBI deputy director Andrew McCabe admitted to knowing and approving the leak.
Cruz claimed McCabe was aware of his decision to approve the disclosure, but Comey claimed that he “denies this claim.”
In May 2017, in testimony to the Senate Judiciary Committee, Comey said in a news report on probes involving Trump and Clinton that he “never” was an anonymous source, and he didn’t allow anyone else at the FBI to be an anonymous source.
In his September 2020 testimony, Comey said he was standing in the answer.
“Comey and McCabe’s statements are contradictory and contradictory,” Cruz wrote to the Justice Department. “McCabe says he leaked the leak and said he approved Comey’s approval — effectively allows the leak after the fact. Meanwhile, Comey said he also didn’t know McCabe had any involvement.”
“One of them is lying under oath — a federal crime,” Cruz wrote.
CNBC requested comment from Comey through the publisher of his book.
Trump said in Saturday’s True Social Post aimed at Attorney General Pam Bondy that Coby, New York Attorney General Letitia James, and D-California Senator Adam Schiff, “I’m guilty like hell, but I’m not going to do anything.”
“Then we’ve supported US lawyers who supported Democrats in Virginia, and we’ve really badly in the Republican past. Awakened Reno, who wasn’t going to do the job,” Trump wrote.
“That’s why two of the worst Senators Dem pushed him so hard. He lied to the media and told him he had quit and we had no case,” Trump wrote.
“No, I fired him, and there are great cases, and so many lawyers and legal critics say. Lindsay Harrigan is a really good lawyer and I like you, we can no longer delay our reputation and reliability.
