Months after the Supreme Court ruled that some tariffs were unconstitutional, the first round of tariff refunds have begun to flow in.
Oshkosh Corporation CFO Matt Field confirmed to CNBC that the company began receiving tariff refunds starting Tuesday.
“Following the acceptance of our initial applications, we have begun receiving payments for duty refund claims, which represent the first portion of the total claims submitted,” Field said.
The company has not yet confirmed the total refund amount, Field added.
Basic Fun, which operates Care Bears and Tonka Trucks, also told CNBC that it began receiving tariff refunds starting Tuesday.
CEO Jay Foreman said the refunds so far represent only 5% of the company’s total billings based on earlier invoices.
“We will use the refunded funds to support our cash flow in 2026 and invest in our team. This is the most challenging time of the year for toy companies,” Forman said in a statement. “We are also announcing pay increases to staff to offset the cost of living increase, and will be announcing promotions and greater merit pay increases. We are reinvesting the funds into our business and people.”

The first phase of duty refunds is only for requests for applications completed by CBP within the past 80 days, but the process could take several months to reach customers.
U.S. Customs and Border Protection said in a court filing that it expects to pay out $35.46 billion in refunds for 8.3 million shipments as of Monday morning.
In February, the Supreme Court invalidated President Donald Trump’s tariffs imposed under the International Emergency Economic Powers Act of 1977. In the months that followed, companies began applying for customs duty refunds through a portal called Integrated Management and Input Processing.
On Tuesday morning, President Trump said in a radio interview with WABC that the tariff refund situation is “insane.”
“In theory, we should return the tariffs. We will fight that,” Trump said. “We were taking wealth from people who hate us, from countries and companies that hate us.”
