President Donald Trump on Wednesday challenged her to remove her while an order from a federal judge prevented him from firing Federal Reserve Gov. Lisa Cook.
The appeal said in her decision that U.S. District Jia Cobb “The public interest in the independence of the Federal Reserve system shows weight in favour of Cook’s reinstatement.”
Cobb also said that Cook had “a strong show” that he claimed Trump had denied her removal.
Trump announced on August 25 that he was fired Cook, the first black woman to serve as Fed governor.
The president argued that he was doing so due to allegations by Federal Housing Finance Director Bill Prute that she committed a mortgage fraud.
Cook denies fraud. Her lawyers argue that Trump uses Pulte’s claim as an excuse, and that her removal is part of a presidential pressure campaign on the Fed to cut interest rates.
Trump has appointed two of the seven Fed governors to take part in the interest rate setting decision.
Hours before the appeal was filed Wednesday, the Senate Banking Committee recommended that in a partisan vote, Trump nominee Stephen Milan be approved for the Fed governor seat, which the entire Senate has left vacant due to Adriana Kugler’s surprise resignation last month.
If Cook is eventually removed from the Fed, Trump will get back on track to nominate a majority of the central bank’s board of directors.
